LOCAL STATE OF EMERGENCY TOLLING

**IMPORTANT NOTICE**

State of Emergency Tolling and Extension of Development Orders, Permits and other Authorizations

Pursuant to Section 252.363, Florida Statutes, the State of Emergency declared by Governor DeSantis in relation to the COVID-19 pandemic tolled the period remaining to exercise the rights under a permit or local development order for the duration of the declared emergency (475 days) and extends the period to exercise those rights for six (6) months in addition to the tolled period. This tolling provision applies to:

  • The expiration of a Seminole County development order; and
  • The expiration of a Seminole County Building Permit.

The holder of a Seminole County development order or building permit must notify the Seminole County Development Services Department of his or her intent to exercise the tolling and extension authorized by Section 252.363, Florida Statutes, no later than Monday, September 27, 2021, in order to take advantage of this provision.  The notice must be in writing and identify the specific development order or building permit qualifying for extension.

Local State of Emergency Tolling

Pursuant to the authority under Seminole County Executive Orders 2020-004 and 2021-007, all due dates, expiration dates, or termination dates in zoning and land use applications, agreements, resolutions, and ordinances, as well as formal code enforcement order compliance dates were tolled 454 days and extended an additional six months consistent with the terms of Section 252.363, Florida Statutes.  Example of eligible authorizations include:

  • Land Use and Zoning applications; and
  • Code Enforcement Orders.

The holder of any applicable item must notify the Seminole County Development Services Department of his or her intent to exercise the tolling and extension authorized by Seminole County Executive Orders 2020-004 and 2021-007, no later than Wednesday, September 15, 2021, in order to take advantage of this provision.  The notice must be in writing and identify the specific development order or building permit qualifying for extension.
