Vacate & Abandonment Of A Right-of-way

The process for Vacate and Abandonment of Right-of-Way Easements and/or alleys, located within the unincorporated area of Seminole County or County rights-of-way, requires review by Planning & Development Staff, public notice and approval from the Board of County Commissioners at an advertised Public Hearing.

Per FS 336.09 and FS 336.10, Right-of-Way and/or alley vacate requests are required to have a scheduled public hearing, and require two legal notice advertisements in the newspaper. The completed application must be accompanied by a site plan or survey/sketch of description of the vacate area and the application fee. In addition, a Right-of-Way and/or alley vacate request must include letters of approval/disapproval from all utility companies that service the subject area.

The amount of time required for processing a request for Vacate and Abandonment depends on the type of request, timely submittal of required documents, and scheduling of the public hearing with respect to established scheduling procedures. That time may vary depending on the information received and the completeness of your application.

If the request is approved by the Board of County Commissioners, the proof of advertisements, along with the Resolution adopted by the Board and any associated documents, is recorded in the public records. Upon the Planning & Development Division staff recording the documents, the applicant shall be provided a certified copy, thereby completing the Vacate and Abandonment process.
