Vacate & Abandonment of a
Drainage Easement
The process for Vacate
and Abandonment of Drainage Easements,
located within the unincorporated area
of Seminole County, requires review by
Development Review Staff, public notice
and approval from the Board of County Commissioners
at an advertised Public Hearing.
Drainage Easement vacate
requests are required to have a scheduled
public hearing, and require legal notice
advertisement in the newspaper. The
completed application must be accompanied
by a site plan or survey/sketch of description
of the vacate area and the application
fee.
The amount of time required
for processing a request for Vacate and
Abandonment depends on the type of request,
timely submittal of required documents,
and scheduling of the public hearing with
respect to established scheduling procedures. That
time may vary depending on the information
received and the completeness of your application. The
approximate time is two months. Please
note that if there are any errors in the
legal description of the item to be vacated,
this application cannot be accepted by
this office for processing.
If the request is approved
by the Board of County Commissioners, the
proof of advertisements, along with the
Resolution adopted by the Board and any
associated documents, is recorded in the
public records. The Development Review
Division will contact the applicant to
ask them for a check, made payable to the
CLERK OF THE CIRCUIT COURT to pay the fee
established by the Clerk for recording
the documents in the Public Records. After
receipt of the check, the Development Review
Division will record the documents, and
mail the applicant a certified copy, thereby
completing the Vacate and Abandonment process.
